MEMBERS PRESENT:                        Emma Rhyne, Co-Chair; Steven Bennett; Robin Bristow; John McMahon and Jajala Schweiger.

 

MEMBERS ABSENT:                        Timm Eberly            ; Charles Loundermon, Chair; Rich Adams   and Doris Foreman              

 

STAFF PRESENT:                                    Gianna Mitchell, Human Rights Advocate; John Favret, Hospital Director and Lisa Webster, LHRC Liaison Support, Mark Stevens and Eric  Berthiaume , Disability Rights Advocate -VOPA Representatives    

           

1.         Call to Order

The Local Human Rights Committee meeting was called to order at 10:35 a.m. with Emma Rhyne, Co-Chair presiding, for the purpose of hearing business as presented on the agenda and such other transactions or matters that may be presented to the Committee.   The committee also welcomed VOPA Representative Eric Berthiaume.

 

2.                  Agenda

    The November 15, 2007 Agenda was reviewed.   

           

            Action:            Motion was made by Ms. Bristow and properly seconded by Mr.

McMahon that the LHRC approve the November 15, 2007 Agenda.  The motion passed unanimously.

     

3.            Minutes

Minutes of the October 18, 2007 LHRC meeting were reviewed.

                       

Action:                  Motion was made by Ms. Bristow and properly seconded by Mr.

                      Bennett that the LHRC approve the October 18, 2007 minutes

                      as written.  The motion passed unanimously.

 

4.         Hospital Directors’ Reports

Mr. Favret presented the October 2007 Disposition of the Abuse/Neglect Investigations Report; Facility Monthly Report and the Formal and Informal Complaints Report   (see the November 2007, LHRC packet).

 

Action:          The committee members present accepted the Hospital Directors’

                                                Reports for February 2007.

           

5. Forensics Program Handbooks – High and Low Security Review – Defer until January 17, 2008 meeting.

 

6.            Training - Changes in Human Rights Regulations

Ms. Mitchell stated to the committee that according to the changes in the regulations, Policy and Procedures are reviewed upon request of the committee or Human Rights Advocate.  However, the committee will continue to review  Seclusion/Restraint, Timeout, Rules of Conduct or Behavioral Plans as they were in the old regulations. 

 

December 1, 2007 is when practice for the new regulations begins (i.e. changes in Seclusion/Restraint and Complaint Process).  All providers are given until March for the policies to be presented and implemented reflective of changes to the new regulations.   Advocate will keep the committee informed of policies that relate to Human Rights that need to be reviewed.

 

Ms. Mitchell gave a brief training on the following topics: 

Complaint Process – all complaints will be forwarded to the Human Rights Advocate both formal and informal.

 

Legally Authorized Representative (LAR) has been changed back to Authorized Representative (AR) Evaluations of AR will be reviewed quarterly.

 

Policy and Procedures Reviewreviewed upon request of LHRC Committee or Advocate.

 

7.         Attendance Letter - The draft attendance letter was shared with the

Committee and the members agreed to have it forwarded to the recipient. See Executive Session Minutes

 

The motion was made by Ms. Rhyne properly seconded by Ms. Bristow, and passed for the LHRC to go into executive session pursuant to Virginia Code 2.2-3711(A) 4 for the protection of the privacy of individuals in personal matters not related to public business, namely for the purpose of hearing of authorized representatives, hearing of behavior modifications and/or conducting a hearing pursuant to the regulations.

 

Motion was made by Ms. Bristow and properly seconded by Ms. Schweiger and passed that we go into open session.  The LHRC unanimously certified that, to the best of each member’s knowledge, only private business matters lawfully exempted from statutory open meeting requirements and only private business matters identified in the motion to convene the executive session were discussed in the executive session.

8.            Holiday Party for Geriatric Patients

The Fifth Annual Holiday Party for Geriatric Patients will be held on Thursday December 20, 2007 in building #35 at 1:30 p.m.                        

 

 

6.           ECT Video(s) Review    Ms. Mitchell acknowledged that the committee has

             reviewed all the video that the hospital has to offer.

 

                        Action:     Ms. Mitchell will check with the Librarian about the procedure for    

                              distributing video to family members.

 

7.               Announcement(s)

 8.               Adjournment-

            Having no further business, a motion was made by Ms. Bristow properly  

            seconded by Mr. McMahon that the meeting be adjourned.   The motion passed

 unanimously and the meeting adjourned at 11:40 a.m.  The next scheduled meeting will be held Thursday, January 8, 2008 in Building #33 at 10:30 a.m.

The motion was made by Ms. Rhyne properly seconded by Ms. Bristow, and passed for the LHRC to go into executive session pursuant to Virginia Code 2.2-3711(A) 4 for the protection of the privacy of individuals in personal matters not related to public business, namely for the purpose of hearing of authorized representatives, hearing of behavior modifications and/or conducting a hearing pursuant to the regulations.

 

1.      Attendance Letter

The consumer member can no longer serve on the committee therefore the committee needs to advertise for a consumer position.

 

Action: Ms. Webster will place adds in the Virginia Gazette and the Daily Press soliciting membership for a consumer.
